A non-resident can own a US LLC, but incorporation does not automatically provide an EIN, a bank account or a particular tax outcome. Treat each as a separate step.
Typical order
- choose a state and check name availability;
- appoint a registered agent and file formation documents;
- obtain an EIN under the IRS rules for the actual structure;
- check federal, state and local permits;
- prepare a consistent KYB file for a bank or fintech provider.
Tax caveat
A single-member LLC may be a disregarded entity for federal income tax, but that does not remove possible information returns or state obligations. A foreign-owned US disregarded entity should be reviewed for Form 5472 and a pro forma Form 1120. Do not select a tax treatment solely because a formation agent suggested it.
What a provider will ask
Product, website, customers, countries, source of funds, expected payments and the business connection to the US must be consistent across every form. CrystalCore supports company formation, business accounts and KYB preparation. Obtain US tax advice for the final position.
